Dear Mr. Sahil Oberoi,

I totally agree that If some body has criticized Mr. Bhudhwar in relation to his building of Five star Hotel is totally wrong. It should not happen. No body has right to criticize Personal achievements.    At the same time what you have written in his appreciation is controversial.

It is universally known  fact that Mr. Budhwar is desperately hungry for chair. He has been operating the FAIPT according to his whims and fancies as if FAIPT is his own property.  He has been throwing  out the person who is not convenient to him. You need to make your own research in this respect. If you go back to last  decade and half you yourself will discover how many persons he has changed from  time to time not being convenient to him. Not only that he has damaged associations in most of the prominent states locating alternative person who is convenient to him than the statutorily elected representative of the respective state associations. Thus dividing state associations for his own benefit.

The FAIPT has its own  laid down electoral procedure. There is a laid down procedure for nominating  representatives for every paying members of district/ state  association who forms the managing committe of the FAIPT. Such statutorili formed committee is supposed to decide the fate of the dealer community of entire nation.

Mr.Budhawar spoiled the total structure of managing committee set up. The people those are  not elected representatives and  are  convenient to him only can be taken in managing committee. Others even though duly elected member from respective  states are bad in the eyes of Mr.Budhwar only because they are not convenient to him.

He made electoral procedure controversial. He has created many criticizers for him than colleagues. It is totally untrue that social work is in of his blood. He  has done more damage  to  FAIPT than anybody ever may have done. He is not at all entitle for any kind of appreciation on this count. You may take opinion poll from all the senior leaders of FAIPT from those who were part of the initial managing committee when Mr.Budhwar became the President.

Since you wrote many lines about his appreciation it became  necessary to bring these facts to your notice.

Peak Oil is Here: Now What?

At least peak oil is here if I’ve understood what the peak oil argument is properly. And my problem with the peak oil argument is that it isn’t really very clear in itself as to what it means. From what I understand at some point we get to the end of cheap oil, we’ve only expensive oil left and then, well, and then apparently something terrible happens. But I’ve never been able to get from anyone a clear description of what it is that’s terrible that then happens.

However, we seem to have actually reached that end of cheap oil part, at least we have if this analysis is true:

Tracking data from the 50 largest listed oil and gas producing companies globally (ex FSU) indicates that cash, production and unit costs in 2011 grew at a rate significantly faster than the 10 year average. Last year production costs increased 26% y-o-y, while the unit cost of production increased by 21% y-o-y to US$35.88/bbl. This is significantly higher than the longer term cost growth rates, highlighting continued cost pressures faced by the E&P industry as the incremental barrel continues to become more expensive to produce. The marginal cost of the 50 largest oil and gas producers globally increased to US$92/bbl in 2011, an increase of 11% y-o-y and in-line with historical average CAGR growth. Assuming another double digit increase this year, marginal costs for the 50 largest oil and gas producers could reach close to US$100/bbl.

It’s the marginal, not the unit or average, costs which have the greatest influence upon prices in a market. Obviously so: those supplies with the highest marginal costs will be the first to disappear if the market price drops.

So, again assuming that this analysis is correct, we seem to have come to the end of the age of cheap oil. At least, cheap oil in the sort of volume that we are used to using. This is pretty much the same as what everyone says will happen when we get to peak oil so we can I assume say that whatever will happen with peak oil should be happening now?

Which is, erm, what? Sure, the countries of Europe and North America are looking a little tired in their economic growth. But then they are still trying to escape from the effects of a near meltdown of the financial system. Something that is known to cause recessions and reduce growth.

On the other hand the global economy looks just fine. Growth continues, poor countries continue to get richer, we’re still in the middle of the greatest reduction in poverty in the history of our species.

So what is it that is supposed to happen when we run out of cheap oil and why is it that whatever it is isn’t happening now?

New Delhi: Consumers could prepare for shortages in auto and cooking fuel supplies. Oil retailers IOC, HPCL and BPCL have informed the government that if their losses from selling fuel below cost are not adequately compensated, “it may adversely impact the supply-demand balance of petroleum products,” Minister of state for petroleum and natural gas R.P.N. Singh told Rajya Sabha on Tuesday.

Singh said that in the light of the Kirit Parikh committee’s recommendations the government took a decision ‘in principle’ on June 25, 2010 that diesel price would be made market-determined both at the refinery gate and retail level. “However, in order to insulate the common man from the impact of rise in international oi prices and the domestic inflationary conditions, the government continues to modulate the retail selling prices of diesel, public distribution kerosene and domestic LPG,” the minister said.

Singh said that companies are losing Rs 14.29 per litre of diesel, Rs 31.04 on a litre of kerosene and Rs 570 per cylinder of LPG. In the 2012 fiscal, retailers have incurred a loss of Rs 1,38,406 crore.

The minister also said that although petrol price has been deregulated from June 26, 2010, companies have been making price revisions on petrol “in a guarded manner, at times, absorbing a part of under-recovery themselves.” Companies have also asked the government to cut the excise duty on petrol.

To reduce the burden of higher global oil prices on consumers, the government had in June 2011 removed the 5% customs duty on crude oil and effected a similar duty cuty on finished petroleum products. Excise duty on diesel was also cut by Rs 2.60 a litre, leading to a loss of Rs 49,000 crore to the exchequer. Courtesy : FE

Dear Sir,

              We are very sorry and shocked to write that Territory Manager ( Retail ) – Ambala ( Haryana ) Sh. Anil Kumar has been caught red handed by CBI while accepting the bribe of Rs. 3.0 Lac from a dealer. The copy of the news item is attached for your ready reference.

This is only tip of the iceberg. A fair inquiry by the competent authority will reveal that there are numerous BPCL officials still serving in various capacities who are involved in corrupt practices of one kind or the other by unduly harassing and blackmailing the dealer / transporter community in Haryana. We had brought this into the notice of authorities many a times in the past. But the deliberate inaction by systematic cold shouldering of the issues had emboldened these officials which led to this unfortunate situation.

We have all the reasons to believe that Sh Anil Kumar could not indulge in the corrupt practices on his own. He was aptly supported in this endeavour by a team of few subordinate and senior officials.  The caucus/unholy alliance of such tainted officials must be exposed for the sake of goodwill and honour of BPCL. All these black sheep must be identified and shown the exit door from BPCL at the earliest in order to restore the confidence of the dealer community & the customers in the system.

Few of the following reasons can be attributed to the downfall of BPCL in the area over a period of time :

1.  Posting of tainted officials with doubtful integrity at various positions in Haryana. Transfer of honest and upright officers to far flung areas as a reward for their honesty and integrity.

2. Lack of periodic meetings and interaction with the dealers and transporters in the open house to resolve their grievances and problems.

3. Systematic false propaganda against BPCL dealers of Haryana by these area officials to mislead the higher management in order to create a wedge and bias /  prejudice their mind against the dealer community.

4. Inhuman treatment to dealers as their subjects / slaves by the officials.

5. Lack of transparency in the system. No information / communication to the dealers / transporters regarding various schemes, policies etc from time to time.

6.  No acknowledgement of communication and letters from the dealers / transporters in order to avoid responsibility and accountability for the inaction or delayed action on their part by the officials.

7. Lack of accountability / fixation of responsibility of the officials for their acts of omission and commission.

8. Undue harassment and victimisation of the whistle blower dealers by the officials to discourage and silence them.

9. Lack of any cross check or audit by the third party on the expenditure and the work carried out by the officials at ROs.

10. Undue delay in granting sanction for the prosecution of the corrupt BPCL officials apprehended by CBI or other govt agencies in the past.

On 30.11.2011 an emergency meeting of the Haryana BPCL Dealers Association was held at Pipli (Kurukshetra) to take stock of the situation. The dealers’ community at large was very agitated and upset by the development and expressed grave concern at the manner in which affairs of BPCL are being managed in Haryana. They were very upset with the style of functioning and governance of the BPCL officials in the area.  Many dealers quoted various instances of their victimisation at the hands of these officials and their modus operandi under the prevailing circumstances which we believe must be shared with you.

Retail Related issues: 

1. Threat and showcase notices to dealers to suspend their sales or close down the ROs on account of drop in sales due to various reasons in order to blackmail them.

2. Forced upliftment of low selling branded fuel thereby causing undue financial loss to the BPCL dealers in order to meet some flimsy targets or just to please their superiors by presenting them with misleading sales figures.

3. Selective distribution of subsidies on various items to the chosen few dealers in a clandestine manner by deliberately hiding the details of the scheme and BPCL policies from the dealers’ community at large i.e. without sharing the provision and availability of various kinds / types of subsidies for the BPCL RO Dealers (under different categories of ROs) and the corresponding criteria, conditions, procedure, rules and regulations etc for releasing the same to them.

4. Unilateral launch of sales promotion schemes in the area without taking the concerned dealers into the confidence and without holding any meeting with them. Thereafter, not delivering scheme items (coupons, rewards, ad materials etc) well in time thereby defeating the very purpose of the scheme for which it is launched causing resentment amongst the dealers and their customers. On top of it supply of substandard gift items to ROs after purchasing them at exorbitant prices.

5. Undue long delays in releasing the various types of the reimbursements to the dealers (stamping fee, sampling fee etc ). Huge amount is still overdue to the dealers.

6. Non acknowledgement / receipt for any communication / letters etc from the dealers by the officials to avoid and escape responsibility for their inaction / delayed action. They arrogantly claim that they are under no obligation to give any acknowledgement / receipt to the dealers.

7. Undue delay in processing of reconstitution cases by the officials thereby causing great hardship and risk to the smooth functioning of the ROs.

8.  No general house interaction / meeting with the dealers to discuss their problems and resolve their grievances as was being done in the past. Now the officials hold individual level meeting with the dealers to threaten and blackmail them.

Engineering Related Issues :

1.  Undue delay in attendance of the dealers engineering related complaints.

2. Use of substandard materials ( e.g. nozzles of MPDs etc) at the ROs by the area officials.

3. Dealers engineering complaints in BROMA closed by the officials of their own without resolving them to the satisfaction of the dealers just to please the contractors / fitters for some obvious reasons.

4. Undue delay in obtaining the renewal of the Explosive Licenses and obtaining other mandatory clearances from the various Govt departments for the ROs in the area (at many times this may have lead to the closure of the RO by the Govt authorities ).

5. Forcing dealers to pay to the government officials to make them overlook the short comings and irregularities done by BPCL officials at their ROs. Non reimbursement of the penalties levied by different Govt agencies on the ROs on account of the inaction or irregularities done by the area BPCL officials at those ROs.

Depot Related issues :

1. Continuous short supply of petroleum products from the different depots in Haryana with the aid of short Calibration towers located in those depots of BPCL (Evidence is on the records of BPCL). Sometime back Rewari Depot in Haryana was challaned by the Weights & Measurement Department for short calibration tower. But to everyone’s surprise no action was taken against the guilty officials by BPCL. The calibration towers at Piyala Location are also short. Do BPCL officials enjoy right to supply short product to their ROs since no action is being taken against them? Is it approved by the higher management?

2. Short RTKM of various ROs ex various depots of BPCL in Haryana resulting in financial loss to the transporters. No corrective action taken inspite of our repeated requests and representations in this regard.

3.  Denial / Undue delay in releasing the rightful arrear payments to the transporters.

4. Violation of transport tender conditions e.g. prevalence of two different transport rates for the same PCVO operating at a BPCL location after execution of agreement, transport rates escalation formula and many other terms and conditions in the ongoing transport tender modified retrospectively as per their own convenience by area officials of BPCL.

These are few of the problems / issues being faced by the BPCL dealers’/ transporters community at large. The corruption is prevailing in BPCL because many BPCL officials consider themselves to be above the law of the land. They have scant respect for RTI Act. Until and unless the rule of law is not implemented and followed the corruption cannot be controlled and removed.

We had duly brought the various instances of irregularities and corrupt practices of the area BPCL officials into the notice of your predecessors in the past. But due to some reason best known to them they did not take any action against them.

We are greatly concerned about the deteriorating honour and dignity of BPCL and its dealers in Haryana. Therefore, we want to discuss the issues at length with you in person in a meeting at the earliest (as per your convenience) to restore the confidence of the BPCL dealers and the customers.

If our representation is ignored as before then we shall be forced to believe that higher management of BPCL is also sheltering and protecting scores of officials like Sh. Anil Kumar in one way or the other. We request you to get the matter investigated by some independent agency to set the house in order otherwise we shall be compelled to put our grievances before Ministry of Petroleum & Natural Gas, Govt of India or move Apex Court as per the law. Also please keep us informed regarding the progress in this matter from time to time.

Dealer community in Haryana is truly and fully committed to BPCL and not to its few corrupt officials. Enough is enough.

CBI COUGHT TM BPCL IN AMBALA HARYANA IN CORRUPTION RUPPEE 3 LAC


अंबाला, वसं : केंद्रीय जांच ब्यूरो की टीम ने शुक्रवार देर रात भारत पेट्रोलियम कारपोरेशन लिमिटेड के टीएम अनिल कुमार को तीन लाख रुपये की रिश्वत लेते गिरफ्तार किया है। इसके बाद यहां बीपीसीएल और दिल्ली स्थिति उसकी कोठियों पर छापे भी मारे गए। शनिवार को उसे विशेष अदालत में पेश किया जाएगा। बताते हैं कि कम बिक्री होने के कारण रादौर के खेड़ी लक्खा सिंह के निकट एक पेट्रोल पंप की सप्लाई नवंबर माह के पहले सप्ताह में बंद कर दी गई थी। सप्लाई शुरू कराने के लिए पंप मालिक सतीश आहूजा ने पंजाब के लालड़ू स्थित बीपीसीएल के टर्मिनल मैनेजर (टीएम) अनिल कुमार से संपर्क साधा, तो उसने पेट्रोल की सप्लाई शुरू कराने के लिए रिश्वत की मांग रखी। आहूजा ने चंडीगढ़ स्थित सीबीआइ के डीआइजी महेश अग्रवाल से इसकी शिकायत की। इसके बाद सीबीआइ के एएसपी के नेतृत्व में टीम गठित की गई। पंप मालिक ने अनिल कुमार से संपर्क साधा जिसके बाद दोनों की अंबाला शहर के सेक्टर नौ स्थित होटल में मीटिंग तय हो गई। शुक्रवार रात जैसे ही पंप मालिक ने टीएम को तीन लाख रुपये दिए, सीबीआइ ने दबोच लिया। इसके बाद सीबीआइ की एक टीम ने दिल्ली स्थित अधिकारी के आवास पर छापा मारा, जबकि दूसरी टीम ने अंबाला शहर बीपीसीएल कालोनी में। अधिकारी की कोठियों में रात पौने बारह बजे तक छापेमारी की गई। उसने अनिल कुमार का लैपटाप कब्जे में ले लिया है। पता चला है कि टीएम अनिल कुमार के दिल्ली में एक, नोएडा में तीन और जोधपुर में एक फ्लैट हैं, जिनकी कीमत तो करोड़ों में है। सीबीआइ के डीआइजी महेश अग्रवाल ने बताया कि टीएम को तीन लाख रुपये रिश्वत लेते गिरफ्तार किया गया है।
